Australia’s Student and Student Guardian visa rules changed on 2 October 2026, and renewed reporting this week has raised questions about family moves and applications made inside the country. The official summary of student visa changes identifies both issues as central to the reform. These rules began earlier in October; they were not first introduced this week.
Applying from inside Australia
The ministerial announcement says most temporary visa holders, including Working Holiday Maker and Skills in Demand holders, can no longer apply for a Student visa while in Australia. Existing students seeking a further onshore visa must meet the relevant requirements, including rules concerning genuine course progression and available exemptions.
This makes the place of application an early eligibility question. Receiving an offer from an education provider does not by itself establish that a person can lodge the visa application without leaving Australia. The current visa subclass and the exact proposed study both need review.
Family plans need a separate check
The reform restricts inclusion of partners and children, with limited exemptions described in the official materials. The ministerial release identifies PhD students, nationals of Pacific and ASEAN countries, and government-sponsored students among the groups with exceptions. It also says the ability to add family as subsequent entrants has been removed.
The Student visa application rules factsheet should be read alongside the individual visa instructions before a family buys tickets or arranges housing. Timing and existing family visa circumstances can matter. A general headline cannot resolve a household’s eligibility.
Keep the 2027 proposal separate
The government has also announced a new Student visa transfer stream for 2027. That future element should not be confused with the application rules already in effect. The official release sets out transitional provider-transfer restrictions as well.
For a practical review, assemble current visa grants, the new course offer, qualification level, funding evidence and each family member’s immigration position. Then work through the department’s current application and family decision guides. This week’s attention is a reason to check the details before committing to a study plan, especially where the plan assumes an onshore switch or family joining later.
