A targeted provision in the UK’s Skilled Worker rules addresses people formally identified as victims of modern slavery. The current Appendix Skilled Worker includes an exception allowing certain work conditions to be amended after a qualifying positive Conclusive Grounds decision.
The rule requires a referral into the National Referral Mechanism and a positive decision made during the person’s most recent permission. It says conditions may be changed to permit work, including self-employment and voluntary work, while retaining the restriction on professional sportsperson work. These details matter: reporting concerns or receiving an initial response is not necessarily the qualifying decision.
Get the permission position checked
The Home Office’s explanatory memorandum describes the change as support for recognised victims, reducing the dependence created by a sponsored job. It should not be interpreted as an unrestricted right for every Skilled Worker to move to any employer.
A person affected by exploitation should obtain confidential advice about both protection and immigration permission. Ask an adviser to check the decision received, the date of that decision and the current conditions attached to the visa. Before starting another role, establish whether the necessary amendment has been made and what evidence demonstrates it.
Keep work, protection and status records together
Where safe, retain employment records, immigration decisions and relevant correspondence. Make a chronology that separates the original visa grant, referral, decision and any subsequent change of conditions. This can help an adviser identify the right next step without relying on an employer’s explanation of the law.
Support needs may extend beyond permission to work. Housing, access to money, identity documents and safe communications can all affect the ability to leave an exploitative situation. Seek appropriate specialist help rather than attempting to resolve every issue through the sponsoring employer.
This article explains an existing October amendment; it is not a declaration that a particular individual qualifies. The important distinction is between a protective legal mechanism and an automatic visa change. The exact decision and immigration record must be reviewed before relying on the exception.
